Continual Werk Agreement

This Agreement is made on the day in which it was signed, 2024, by and between The Spiritual Experience LLC (TSE)and client. It constitutes a binding contract between the parties and is with TSE, a Colorado LLC, not with Candice Wells personally.


1. Coaching Services

TSE agrees to provide ongoing coaching services under the Continual Werk Membership.  This membership is for clients seeking continual support in their personal and business development, with a focus on accountability, growth tracking, and tailored guidance.


2. Description of Services

Continual Werk Membership includes:

- One 60-minute coaching call per month

- Unlimited Voxer support (Tues-Fri, 11am-7pm MT)

- Personalized accountability, tracking progress towards goals

- Access to additional resources and homework assignments


3. Recurring Monthly Payment

The Continual Werk Membership is a recurring monthly subscription of $299 USD. 

- Payment is every 30 days from the day it starts.

- Payments will be automatically billed via the payment method set up during registration.


4. Coach-Client Relationship**

- TSE adheres to the International Coach Federation (ICF) standards.

- The Client is responsible for their decisions, actions, and progress.

- Coaching is not therapy, and the Client agrees to communicate openly and participate fully.


5. Confidentiality

All shared information is confidential unless required by law or in cases of potential harm to self or others.


6. Cancellation Policy

Client agrees to provide 24 hours’ notice to cancel or reschedule a session. Missed meetings without notice may still be billed.


7. Termination & Refunds**

Either party may terminate the agreement with written notice. Refunds will be subject to the following:

- Termination before the next scheduled payment: No refunds for the current month, but future payments will cease.

- No refunds will be issued for services already rendered or materials already provided.


8. Limited Liability

The Client agrees that TSE will not be held liable for any tangible or intangible damage as a result of participation in the program. Results depend on the Client’s decisions and actions.


9. Client Responsibilities

The Client agrees to:

- Commit to the goals set in coaching sessions

- Provide truthful information for effective coaching

- Adhere to scheduling policies and engage actively in the membership


10. Assumption of Risk

Participation in the program may involve risks. The Client assumes all risks and agrees not to hold TSE liable.


11. Indemnification

The Client agrees to indemnify and hold harmless TSE, its representatives, and affiliates from any claims or actions arising from their participation in the program.


12. Entire Agreement

This document reflects the entire agreement between TSE and the Client and supersedes any prior agreements.


Client Responsibilities

1. Non-Disclosure of Trade Secrets

   Clients must inform The Spiritual Experience (TSE) of sensitive trade secrets both verbally and in writing. TSE will not use these to benefit another client.


2. Waiving All Claims

   Clients acknowledge responsibility for their own business decisions and waive any claims against TSE or its representatives based on advice provided.


3. Providing Truthful Information

   Clients must provide truthful and complete information for effective coaching.


4. Scheduling & Cancellation Policy

   - Appointments must be scheduled 2 business days in advance via candiwerk.com.  

   - 24-hour notice is required for cancellations.  

   - Repeated no-shows or lateness may result in service termination.


5. Health Policy

   Clients should notify TSE if they are ill and avoid in-person sessions. Services can continue virtually.


6. Advising Location

   Sessions are held via Zoom unless otherwise agreed. Appointments may not take place at a participant’s home.


7. Follow-up & Progress 

   Follow-up may take up to 7 business days. Clients are expected to make progress toward goals or notify TSE if assistance is needed. Failure to do so may result in service termination.


8. Program Limits & Duration  

   Coaching sessions last one hour, with extensions to be agreed upon. Rescheduled sessions must be completed within 90 days.


9. Telecommunication

   Clients may receive services via phone, Zoom, or Voxer. TSE responds to Voxer messages within 24 hours, Tuesday-Friday.
